Terms of Service of hexjobs.com

Please read these terms carefully before using the hexjobs.com website.

1. Definitions

  • Website – the website available at hexjobs.com and its subdomains.
  • Service – services provided electronically by the Service Provider to Users via the Website.
  • Service Provider – the owner of the hexjobs.com Website, i.e., Apptivity sp. z o.o. with its registered office in Krakow, at ul. Podole 60, entered into the Register of Entrepreneurs of the National Court Register by the District Court for Krakow-Śródmieście in Krakow, 11th Commercial Division of the National Court Register under KRS number: 0001168563, NIP: 6762692212, REGON: 541513315, with a share capital of PLN 5,000.
  • Job Ad – content posted on the Service Provider's Website containing a job offer to inform Users about recruitments conducted by the Advertiser.
  • User – any person visiting the Service Provider's Website.
  • Advertiser – a natural person, legal person, or organizational unit without legal personality conducting business activity who publishes an Ad on the Service Provider's Website.
  • Job Seeker – a Website User whose main goal is to browse Ads published by Advertisers and submit Applications in recruitment processes.
  • Application – expression of the Job Seeker's willingness to participate in the recruitment process conducted by the Advertiser, via the "Apply" button next to the Ad.
  • Form of Application – two possibilities of Application:
    • Sending a CV in electronic form to the Advertiser's e-mail address provided during the publication of the Ad.
    • Redirection to an external recruitment form of the Advertiser in accordance with their regulations.
  • Payment Operator – Stripe Payments Sp. z o.o. with its registered office in Warsaw at ul. Waryńskiego 3a, registered in the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division, KRS 0000937028, NIP: 7011062474, REGON: 520642121, integrating card payments, Apple Pay, Google Pay, PayPal, Blik, and online transfers via the Przelewy24 integrator.

2. General Principles

  1. The Website operates on the principles described in these Terms of Service.
  2. Each User of the Website is obliged to read the provisions of these Terms of Service and comply with them.
  3. Use of the Website constitutes acceptance of the conditions specified in the Terms of Service.
  4. The Terms of Service are publicly available and posted on the Website free of charge.
  5. The current content of the Terms of Service is always available on the Service Provider's Website.

3. Registration and Access to Services

  1. To use the full functionality of the Website, the User may be required to create an account.
  2. The User is obliged to provide true and up-to-date data during registration and to update them immediately in case of change.
  3. It is forbidden to create accounts on behalf of other persons without their consent.
  4. The Administrator reserves the right to verify the identity of Users to ensure the security of Services.
  5. The User is obliged to keep their password confidential and not to share it with third parties. The Administrator is not responsible for actions taken using the User's account by third parties.

4. Rules for Using Services

  • The User undertakes to:

    • Use the Website in accordance with applicable law.
    • Not post harmful, false, offensive content, nor content violating the rights of third parties.
    • Refrain from actions aimed at disrupting the operation of the Website, including hacking attacks or excessive load on servers.

  • Violation of the rules specified in the Terms of Service entitles the Administrator to:

    • Remove content violating the Terms of Service.
    • Suspend or delete the User's account.

5. User Responsibility

  • The User bears full responsibility for all actions taken using their account.
  • In case of unauthorized access to the account, the User is obliged to immediately inform the Administrator.
  • The Service Provider is not responsible for content published by Advertisers and for damages resulting from the use of such content in accordance with the Terms of Service.

6. Rights and Obligations of the Service Provider

  • The Administrator undertakes to:

    • Ensure secure processing of Users' personal data in accordance with applicable law.
    • Maintain the Website in a state enabling the use of Services by Users.
    • Inform Users about significant changes in the functionality of the Website or the Terms of Service.

  • The Administrator reserves the right to:

    • Change the functionality of the Website.
    • Temporarily suspend Services due to maintenance or technical repairs.
    • Block access to the Website in case of violation of the Terms of Service by the User.

7. Cookies and Analytics

  1. The Website uses cookies to analyze traffic and improve the quality of Services provided.
  2. The analytical tools used include, among others, Google Analytics and Microsoft Clarity.
  3. The User has the possibility to manage cookie settings in their web browser.
  4. Use of the Website means consent to the use of cookies in accordance with the Privacy Policy.

8. Posting Ads

8.1. Publication of Ads

  • The Advertiser may publish any number of Ads on the Website at any time.
  • Publication of Ads is paid in accordance with the current price list.

8.2. Publication Process

Publication of an Ad takes place in three steps:

  1. Filling out the Form: The Advertiser completes all required information regarding the job offer in the form available after clicking the "Add Ad" button.
  2. Summary: Review and editing of added Ads before finalization.
  3. Payment: Making a payment at the Payment Operator.

After positive payment execution, the Ad is immediately published after its acceptance by the Website Administrator.

8.3. Changes to the Ad

  • The Advertiser has the possibility to introduce changes to the content of the Ad.
  • Each change requires re-acceptance by the Administrator.

8.4. Ad Removal

  • The Advertiser may delete their Ad at any time.
  • To delete an Ad, the Advertiser should contact the Administrator.

9. Disclaimer

  1. The Service Provider is not responsible for content posted by Advertisers, to the extent resulting from applicable law.
  2. The Service Provider is not responsible for possible damages resulting from the use of Ads by Job Seekers.
  3. The Service Provider does not guarantee the effectiveness of the recruitment process conducted by Advertisers.

10. Changes to the Terms of Service

  1. The Administrator reserves the right to change the Terms of Service for important reasons, such as technological or legal changes.
  2. Information about changes to the Terms of Service will be provided to Users at least 7 days in advance before they enter into force.
  3. The new version of the Terms of Service enters into force on the day indicated in the announcement of changes.

11. Final Provisions

  1. The Terms of Service are subject to the law applicable in the Republic of Poland.
  2. Any disputes arising from the use of the Website will be settled by the court competent for the Service Provider's registered office.
  3. In matters not covered by these Terms of Service, provisions of generally applicable law apply, in particular the Civil Code.
  4. The Terms of Service should be interpreted together with the Privacy Policy available on the Website.

12. Statements and Consents

  1. By using the Website, the User declares that they have read the Terms of Service and accept its provisions.
  2. The User consents to the processing of their personal data in accordance with the Service Provider's Privacy Policy.
